RESUMO

This paper covers the study about the freedom of teaching of the private institutions of higher education and their limitations to the light of the Federal Constitution. We divided the work in six chapters. Initially, we studied the historical evolution of the higher education institutions, their juridical natures and several forms of academic organization. With base in those criteria, we accomplished an analysis of the current panorama of the Brazilian higher education. We faced, then, the study on the teaching freedom, being considered his historical evolution, their several dimensions, their varied levels and his characterization as element essential badge of a higher education institution. The limits to the freedom of teaching of the private institutions of higher education, his classification and the study about the origin and the conceptual evolution of the autonomy deprived to the light of the constitutional right, they were object of study of the third chapter. To proceed, we defined the instrumental limits to the teaching freedom, their objectives, the constitutional model, and the controlling institutions and controlled by the control forms. The material limits to the teaching freedom, in other words, the fundamental objectives of the Brazilian State and the fundamental rights were approached in the fifth chapter. In the sixth chapter, we analyzed, in way no exhausting, some fundamental rights as material limits to the freedom of the private institutions of higher education
