RESUMO

The socio-educational measure of semi liberty, present in the Statute of the Child and the Adolescent (ECA), is a right-restrictive measure and, as such, holds an adolescent legally responsible for committing an infractional act and implies the institutionalization of this adolescent. Besides, it also establishes the compulsory schooling and professionalization of the adolescent as the measure is being enacted, thus requiring it to be executed by the articulation of the different public and social policies. However, the semi liberty socioeducational service in Brazil is still unsure and erratic, even after ECAs nineteen years of duration. This work aims at investigating if the semi liberty socio-educational service structure (organization and operation), including the institutional dynamics and practices offered in the institutions, has provided adolescents with a concrete enjoyment of human rights citizenship and favored the fulfillment of its socio-educational measure. A quantitative and qualitative research, conducted in 2004, 2006, and 2008, enabled the making of a sociodemographic profile of adolescents under the measure and also to know the facilities available for semi liberty service and the spatial distribution of institutions throughout the country. It has been concluded that the structure, organization, and operation of the institutions for executing the semi liberty socio-educational measure, in addition to the institutional practices developed by the professional corpus of these institutions, favor the acknowledgement of these adolescents as a category of non-citizens or, at best, provide them a fragmented citizenship centered on the status of citizen. The erratic actions and omissions, much more focused on the rhetorical discourse of full protection, added to the material resources offered in socio-educational service as a poor to poor policy, have only contributed to marginalize the adolescent, to criminalize poverty and to discredit the socio-educational measure as an alternative to internment. Therefore, the central hypothesis of the work has been confirmed, that is, that the institutional grammar and its daily practices violate the adolescents human rights of citizenship, disarticulate their life with the public world of these rights, pushing them further away from the concrete experience of citizenship and contribute to the noncompliance of its socio-educational measure.
