Outorga onerosa e transferência do direito de construir : as experiências de Bogotá, Curitiba e São Paulo como instrumentos de gestão urbana

RESUMO

Since 1950, the population of the cities grows in an accelerated way, increasing the necessities to welcome the different demands by health, education, recreation and housing. That growth has influenced the production of the urban space, which, in most of the cases, happens in a dynamic and disorganized form. Thus, the use and the rational occupation of the urban space are fundamentals for the sustainability of the cities, being an obligatory matter of contemporary urban management. The Purchase and Transfer of Development Rights are instruments more and more spread for the organization of the urban space. This research elaborate recommendations for its implementation in Bogotá, having the support of the experiences of Curitiba and São Paulo, analyzed under relative approaches to programmatic, legal, institutional and economic aspects. Methodologically, the investigation is sustained in the revision of Literature and the formulation of a basic analytical structure that allows to recognize and to evaluate the selected experiences. The results are, in first place an analisys about the state of art of the instruments, in the selected cities, in relation with the research protocol. And in second place, a list of recommendations for Bogotá directed to the definition of: urban areas to apply the instruments, laws to guide the process, organizations in charge of its implementation and management, and economic aspects that stimulate their development.
