RESUMO

This research is related to the rights of town planning with focus in the new Law n 10.257/01 Statute of the City, for believing that this law gathers important urbanistic, tax and juridical instruments, that can guarantee larger effectiveness to the Master Plan and the urban administration. This way, it has, as general objective, to do a comparative analysis of the use of the instruments of Transfer of the Right of Building and the Grants Onerous of the Right of Building in the municipal districts of Curitiba and Blumenau. Curitiba is appeared, national and internationally, as model in planning and urban administration, being pioneering nationally in the use of these instruments of urban politics. Blumenau stands out as pioneer in the use of the new instruments of urban politics in the area of the Valley of Itajaí SC. To reach the proposed objectives, it is accomplished a qualitative research with the inductive analysis of the data. Consequently, the research analyzes the legal foundations, the practice of the use of the instruments Transfer of the Right of Building and the Grants Onerous of the Right of Building and the results reached in the municipal districts in subject. In short, things out, it is ended that the instruments of politics urban Transfer of the Right of Building and the Grants Onerous of the Right of Building constitute, if they are well applied, effective instruments to protect and to motivate the preservation of the areas and goods of natural, historical and architectural values.
