RESUMO

This dissertation has a purpose to discourse and affirm, conclusively, about the constitutionality of the anticipated guardianship effects, novel procedural civil institute, which has been integrated into the brazilin juridical system from the punctual reform undertaken with the objective to modernize the jurisdictional activity performance, giving a better effectiveness to the process and to the pretended ample access to the juridical order, minimizing the critics as well, sometimes justified, as juridical inefficiency. Through out this research, considerations concerning the general theory of principals has been developed, of the institutional requisites and of the reason of axiology for being the anticipation of the constitutional guardianship, without the obstruction of the consecrated principals of the legal process, of the contradictory and the ample defense.
