RESUMO

The change in paradigm of the family and the insertion of new familiar formations in the social scene charged the Law the necessity to redefine the concepts and define new parameters of question analysis that are presented in the society legitimately. One of the questions that has most provoked concerns in the legal way is related to the deriving demands of the affectionate homosexual relations as much in function of its specification as of the inexistence of legislation. This study has the objective to approach the homosexual relation union concerned to the share of goods and to the adoption considering that the study of family, in Law, was traditionally supported in the standard model, taking the operators of the Law who are in charge of this arduous task to judge such lawsuit to appeal to the analogy of a steady union. One searched to focus the changes in the family picture, as well as the appearance of the new family units, the change in the conceptual Law picture in the sense of cover in different ways, the new and real social necessities having as basic principles the lay character of state, the dignity of the Human being person, the intransigent defense of equality and universality of rights. The difficult guardianship of the homosexual relation have searched support in these principles, however the decisions are not always correspondent to the expectations of the people involved
