RESUMO
The current thesis identifies that through the history, the development individual and collective is the goal of any society to the efficient harmony among its members and the realization of their wishes. Reach this ideal is the key to legal orderly, creating properly the legislative instruments and permiting a correct interpretation by the law makers, making an alignment of the legal norms in a context of identification of the collective primary interest. Back to environment, in a relation with the right to build, there is a counter-position that must be properly supported through instruments of interpretation to long for social development, cultural, industrial, environmental and urban, avoiding things to stuck the production. Become imperative a relativeness of concepts and parameters, preserving environmental resources and looking for a way of appropriate legal rules to a hierarchy, where the value, principles and the direction will be always in evidence. A healthy life, the correct protection of environment, with a preservative hallmark supported in an effective development of the society, where the right to build is placed as a instrument of propriety right, without impediments legal or administratives, facing concepts and analyzing the situations, is the north that must be followed for all people, be individuals or public agents when under their functions, without never to forget the transitority of the human being in search of current and future happiness
