RESUMO

Falsifiability and law: a new perspective for the interpretation of the juridical science in the contemporary society. The falsifiability is a demarcation criterion proposed by Popper that distinguishes scientific knowledge from other kinds of knowledge and that obtained great repercussion in theory of knowledge. The criterion, nearly disdained by legal epistemology until now, discards legal knowledge as scientific, both in its formulation by the ancient natural law theory and in the recent formulation of formalist positivism. It lies in the meeting of Poppers proposition with Alf Rosss legal epistemologic conception of Law as a fact the possibility to construct a legal knowledge as an empirical science, enabling a different thinking of the Law in a new perspective suitable to contemporary democratic societies.
