RESUMO

The right to the basic education was consecrated in the social and basic text constitutional Brazilian as right, of subjective public law, obligator and gratuitous. However, if it has seen a lack of the pertaining to school education, and consequent a social exclusion that submits the Country to a system of impossibility of adequate development. As effect, constitutional ruleses exist and infra-constitutional that they determine as to have of the State in materializing the universal access the education. Of this form, the present work has as target to evidence that the effective popularization of the knowledge, through the universalization of the basic education, being a basic social right, happened of the personality human being, translates, of efficient form, an education that can assure the full development of the person, its qualification for the work and the conscientious exercise of the citizenship. For such desideratum, the Public Power is necessary must adjust the ways of equality of conditions for the access and permanence in the school, as well as the quality assurance it education, passing for the valuation professional them of the area.
