Direito e política : pressupostos para a análise de questões políticas pelo judiciário à luz do princípio democrático / The work is about the democratic legitimacy of the judiciary in dealing with political issues. It was necessary to establish the scope of work, language, concept and other implications of politics on law, demonstrating that there is an overdetermination of law or politics by a tension between them. As a basis of political activity practiced by magistrates, IT analyzes the political character of constitutional law, the phenomena of activism, self-restraint, neutrality, and legalization of politics, showing the causes and consequences of this process in the Brazilian state. The interpretative process of judicial activity in the political context, is evaluated on the basis of the teachings from Hermann Heller, Carl Schmitt, Norberto Bobbio, Ronald Dworkin and other legal thinkers, emphasizing the historical and philosophical foundation of the ideas of Aristotle, Machiavelli, Rousseau and others thinkers. The concept of political questions in the United States law and the acceptance of such doctrine in the national legal literature and by the jurisprudence of the Brazilian high courts are also discussed, emphasizing the limits of judicial action according to democratic principles. The relevance of the theme is reflected in the remodeling of the judicial function because of to the judicial review and democratic stabilization in Brazil. Thus, it was possible to find basis for a legitimate action of the judiciary in dealing with political issues, presenting criteria for such activity. Keywords: Politics and Law. Political Questions.
