RESUMO

This thesis deals with the examination of what happened on discrimination about the elderly worker in Brazil because of the so-caled prejudice as such from the age of thirty-five years old A concise study is initially made about the values and among them respect and justice and to follow we also examine the norms existing in our ranking and its symbolic meanings checking, after watching several details we reached the conclusion that they had some hints of positivity, thatÂs to say efficacity in what regards the juridical principles and not only of recommendation an that the norms of the human dignity and in what concerns the equality in law that in our ownconstitutional order which gives strength to uproot from our daily orders discrimination, namely referring to work reality and therefore discrimination toward the elderly worker which is the principal topic of this research of ours. Hence we made separatedly detailed glances on the values, the principles of the rights, the principles of the human dignity and the equality, according to the law and only then after taking into account all thatÂs happening on all forms of discrimination in the worldy work either on account or the sex, race, color, origin, age, or on the sexual choice among others; each one of the occasions has been examined so that in the end they might squeeze the work to discriminate the elderly worker. The initial worry of the research on this moment was to investigate why does discrimination exist in what regards the elderly worker is considered soon unable for work (about 35 years old).We can easily draw the conclusion that the âglobalizationâ is the reason for discrimination because of its being essentially excludent, just considering fit the 14 worker who contributes majorly to the market that has become the new master of modernity whereas the human being is put aside in a second plan or even worse than this specially if he does not adjust to total quality so much exalted by the global reality, which is competition, quite often without ethics and without philosophical basis among the markets or even among nations. At the end of this work, after examining carefully the familiar, social situation and the work of the elderly worker; we dare suggest some means to fight discrimination to the aged worker, namely commenting and suggesting to the plan going through official channels regarding the aged men (or women) status which is in the National Brazilian Congress, suggestions to fight discrimination, as well as benefits to businessmen to hire elderly people (both men and women in this status), believing that with this tiny research we may contribute to such an exciting topic unfortunately so alive in this modern world of ours
