Princípios constitucionais em conflito: uma perspectiva no direito brasileiro

RESUMO
The constitutional principles are the object of this study as species of legal principles and the conflicts that occur among this special category of norms. Therefore the differences between the rules and the legal principles are analyzed, particularly the differences between the rules and the constitutional principles. In this context, the proper legal antinomies (conflict of rules) and the improper (competing principles) are defined, granting theoretical foundations for the discussion about the means of solving such conflicts. The issue presented consists in showing how to solve the conflicts between constitutional principles, and the analysis of pondering on interests as an alternative for the solution of such conflicts is the major subject of this work. The tools, which enable the application of such technique, such as the law of balancing, formulated by Robert Alexy, the principle of practical agreement or the principle of harmonization, by Konrad Hesse and the doctrine of proportionality are studied. Finally, the approach to constitutional principles in Brazilian law is analyzed based on selected judicial decisions, in order to identify the application of the method of pondering of interests and the doctrine of proportionality by national Judicial Power in the solution of conflicts, as well as its recognition as a valid and an efficient mean of legal interpretation. The methodology of research employed here corresponds to the logicalsystematic method, associated to the investigation of bibliographic, legislative and judicial decisions materials
