RESUMO

In this monograph we will analyze the ticket of the liberal State for the social one, therefore it is inside of this new State that if develops the necessity of the creation of mechanisms of defense of the social rights. The principle of the social function of the contract came to satisfy these yearnings. We will study the application way it principle of the social function of the contract, its interaction with the other classic principles that conduct the contractual relation and the necessity of the maintenance of the economic essence of the contract in virtue of the application of this new principle. Moreover, we will see of that it forms the other countries apply the principle of the social function of the contract that is a result of the principle of the socialization that influenced all the norms of the new Civil Code.
