Política e religião: o laico e a liberdade religiosa à luz do constitucionalismo brasileiro

RESUMO

The main objective of this study is to analyze the characteristics and the dimensions of laicism and religious freedom according to Brazilian constitutionalism. It is acknowledged that in democratic and pluralist societies the religious actors tend to push the boundaries that separate politics and religion so that the secular state is under constant risk. Laicism is viewed from a gradation perspective whereas religious freedom is associated to a political-constitutional context bound to the optimized exercise of fundamental rights. The search for identifying the aspects and demands imposed by the constitutional challenge to reconcile the preservation of secular state and the exercise of religious freedom is grounded by these double references above mentioned. The present study unfolds from three steps of work. On the first, the relationship between politics and religion in the context of Christianity and Modernity is analyzed. On the second, the most relevant theoretical and doctrinal aspects related to secular state and religious freedom are presented. At last on the third, the evolution and delineation of laicism and religious liberty in the Brazilian Constitutions are investigated. This work searchs to demonstrate that the Constitution of 1988 establishes the legitimating foundations to the Brazilian State that affect laicism and religious freedom, enhancing thus the possibilities of participation and acting of several religious actors in civil society. It is shown that todays existing religious plurality in Brazil and the consolidation of certain principles like citizenship, dignity to the human being and political pluralism by the Brazilian Constitution contribute to the setting up of a pluralist laicism
