RESUMO
The purpose of this dissertation is develop a critical analysis about the meaning of the efficacy and legitimate in the Ambiental Law in the Latin America. For this, depart from historic analysis, political and ideologic, practice and ethical, describing the conditions and values that oriented the construction of Latin American States, since 1492 and the participation in the Ambiental Law. In this context, verify the insert of the Ambiental Law like a mechanism of control and dominance in the "spectacular World", making evident the risk of continue maintain as legitimate implement of the interests of global neoliberalism.Through of a sofistica eloquence, want to occult the engajament with the interests of the market, maintain reliable to objective, clean and impartial knowledge. Opponent this conception a bid of another Ambiental Law will be introduce, the meaning of efficacy and legitimate will be infuence for the Latin Americam liberation philosophy, transposing the sofistica eloquence and choosing for the understanding way as communicative and rational motivation oriented for material ethics of respect unconditional to the life.
