RESUMO
The social right to health in Brazil has been presented as something referred to a suprapositive order of values, taking into consideration its fundamental character. On the other hand, it must be confronted with a different approach, based on the scarcity of budget resources to enforce social rights in general. Apart from the need to concretize these rights, there is the evidence that substantialism, adopted in most cases by our courts, strengthens an undesirable judicial protagonism imposed on social spheres, whose autonomy is then subtracted, preventing the achievement of a plural and democratic environment. The antagonism exposed by these two positions must, therefore, become agonism in order to attain a balance between autonomy and well-being
