RESUMO

Ownership, as it is currently constitutionally protected, can no longer be understood in its liberal conception, in which the owner was allowed to make unlimited use of his property, for ownership is no longer an individual right, but a socially collective one. Because the rules that assure the right to property and to a clean environment have the nature of principles, the use of the Principleâs Theory becomes necessary to, weighing the values involved, find the fairest solution to the presented case, mainly because ownership and environment protection, as fundamental rights, bear the same constitutional dignity, being impossible for one of them to prevail over the other. Unfortunately, despite doctrinary advances in this field, our court precedents still insist in giving ownership the individualist concept of the Liberal State, not considering that the start for any hermeneutical interpretation must be the Constitution and that the social role of ownership is the limit, the internal boundary of property right, reaching all its contents and being an essential condition to the recognition of valid property rights, reason by which there can be no compensation of State created areas to environmental conservation, mainly when the use of property by its owner is not entirely restricted. The present research, starting with the premise that environment conservation is a collective duty, and that no owner has unlimited right to alter the natural configuration of his property without the consent of the proper government authorities, aims to provide the legal community with basic concepts and ideas that can be used to a better understanding of the new constitutional order: environmental protection and the fulfillment of propertyâs social role (completely harmonizable situations and indispensable to human survival and property humanization)
