RESUMO

The education is basic right as life and the freedom. This right has as objective to change the human being for better. For intermediary of the education the person evolves for better and develops the society with this improvement. In the educational process the human being is the object and the person of the education, at the moment to educate and when he is the proper educator. The constitutional text, mainly articles 206, 209 and 214 of the Federal Constitution of Brazil express mention the question of the quality as principle to be observed by the State in the care of the subject the education. However the normative center is not proper of the legal principles and yes of the behavior rules, therefore they deserve different normative classification, for being rule of obligation forecast to make. With this the authors of the right the education can demand the standard of quality in the formal education by means of legal action. To solve the problem considered, we use the historical inquiry of the educational legislation and the learning since the antiquity until the present. The first part of the present work is dedicated to the conceptualization of the education as form of improvement process of the person human being in all its potentialities. It discourses on the ideas and educational processes throughout history, culminating in the description of the legislation on education in Brazil and the world, and still, on the function of UNESCO and its paper in the education. In the second part of the work it is the legal quarrel properly said where if it looks for to determine the direction and reach of the term guarantee in the constitutional rules
