RESUMO

This is a critic work on the research and dogmatic analysis of the juridical fundamental basis which can delimitate the judicial a mount of the constitutional premise referring to the moral damage. It intends to establish the guide elements that can be used as the basis for a more equitable arbitrate of the indemnity âquantumâ in the cases that include this kind of extrapatrimonial loss, as an attempt to eliminate excessive or superficial judgments. Therefore, the finality of this dissertation is to undertake the appreciation of the foreign and national juridical literary, still taking in consideration some judicious positions, as well the evolution the theme in both examined sources. Finally it presents, together with a subjective solution, the objective delimitation of the necessary parameters for a more fair and faithful arbitrate for the constitutional dogmas established by the Brazilian Federal Constitution of 1988 which is the leading mark statement for the existing positions on this subject
