RESUMO

The following work on The Laws of Social Relations (sub-area Labor Laws) has the objective of analyzing and reflecting on the matter of bearers of special needs, either in Brazil or abroad. The choice of the title Positive discrimination and the bearer of special needs suggests that it is unjustifiable that someone is cast from society for having some kind of handicap, either as a citizen or as a producer of goods and services. It shows that negative discrimination is not allowed, but positive discrimination is. The choice for the title is justifiable to show that Brazil, giving opportunities for people who bear special needs - or handicapped, as some prefer - is walking side by side with countries that allow to all, according to each individuals personal conditions, the insertion on modern society. The choice for the title and its development are justified because the bearer of special needs is no longer treated as an outcast. He can not, due to the lack of opportunities given by society, stay at home hiding without any perspectives, just watching life pass him by. One has the right, just as any other citizen, of showing once he is given the right opportunities accordingly to his particular situation as a handicap his qualities as a professional and as a human being. It is very important that the research leading to the accomplishment of this work be presented, facing the repercussions it irradiates, notably, in the hearts and minds of those who still doubt of the potential of the bearers of special needs for society. This work brings reflections not only for Labor Law, but also for other segments of Law. Hence, the work was treated in nine chapters. The conclusions are presented right after the chapters. In the course of this work general research techniques were used, preponderantly the bibliographic technique, involving national authors and some foreigners, as well as direct consultation of normative texts. In the work we adopted, notably, the historical, sociological and comparative methods. Finally, in this work we presented legislation proposals so that, in fact, the bearer of special needs can be included in the work market and that he is respected as a person, allowing the Brazilian society to respect itself and demand to be respected
