RESUMO
The present work is about a new order of hereditary vocation (law n. 10.406- january 10th,2002) compared to alI the systematic family and succession rights of the new Civil Law. We critically analyzed the new legislation as we propose the change of actual Civil Law. We algo examined the actual legislation compared to thelast revoked one, Law n. 3.071, January 1st 1916. Besides presenting thehereditary foreign vocation rules, we analyzed the origin of the succession rights in order to introduce thesubject presented the basic roles of family and succession rights, important to the main subject comprehension. Then, we made a profound study of legal succession, where one can find the order ofhereditary vocation based on alI the means referring to the main subject, including the real estate law either in a marriage or in a "de facto" couple relationship. It will be a precise and systematic work, intended to make a profound-study of hereditary vocation bothin the New Civi lLaw and in the last one. The technical legislation used in the New Civil law is outstanding, and so are the profound change, which come from the New Civil Law, referring to alI the heirs. In short, the present thesis, proposes to show the legislation mistakes, to make the best profound study of the New Civil Law interpretation, as presenting solutions, by legislative changer to the best new order of hereditary vocation improvement
