A bioética e os alimentos transgênicos no âmbito do código de defesa do consumidor

RESUMO

The present monographic work intends to demonstrate the most relevant aspects of the genetically modified grains, the transgenics, mainly how they have been inserted in the consumption market. The question is crucial, once the technical and scientific knowledges cant predict, exactly, its human health and ecological outcomes. Therefore, initially this paper concentrates on the bioethics subject, one of the essential policies that must guide the genetic manipulations activity, also relating it to the Federal Constitution of 1988. Next, it analyzes the biotechnology, also known as the recombinant DNA technology, its evolution and its appliance to the agriculture for the production of the transgenic food, a controversial topic that rebounds all over the world. From there on, the focus of this paper is developed, by the identification of how the subject is inserted in the Brazilian legal system, mostly under the Consumer Defense Code aspect. The biotechnologys specific legislation and the most controversials issues related to the transgenics are observed, such as their labelling, the civil responsibility, the patents, the legislative competency, all confronted with the consumers basic rights and with the guiding principles of this legal system, without forgetting the constitutional text and its principles and rules, also in the environmental question. By that, the present work aims to establish an extensive debate over the topic, analyzing the benefits that the technology provides and will provide to the quality of life improvement, but also alerting to the necessity of a rigid control by the Government, otherwise it may transform into a real threat to humankind
