RESUMO

This dissertation is devoted to investigating liability for toxic exposures and enhanced risk. The first chapter is dedicated to studying tort law in Brazilian law and to demonstrate its insufficiency to support toxic exposure cases. In the following chapter it is analyzed the contemporary society under sociological doctrine of risk society, in which is verified it is characterized for its reflexivity. The risks under which people live are illustrated through description of circumstances of everyday life of two cities in the State of Bahia, Santo Amaro da Purificação and Caetité. In reference to the monographs of International Agency for Research on Cancer, it is verified the existence of studies sufficiently necessaries for establishing epidemiological causation between a toxic substance and a disease suffered by somebody. There are lot of fundaments for tort law in toxic exposure cases: bioethics as limits of scientific freedom, constitutionalization of civil law, personalization of tort law and its trends of always support the plaintiff, assumed responsibility of those who choose to develop dangerous activities, fundamental right to health and precautionary principle. It is proposed three kinds of compensation for toxic exposure: medical monitoring, compensation for moral damage for fear of future disease and compensation for enhanced risk of future disease.
