Relações Brasil e Bolívia: o caso da nacionalização dos recursos hidrocarbonetos da Bolívia

RESUMO

The nationalization of the hydrocarbons of Bolívia occurred according to the supreme decree no. 28.071 of May 1st, 2006. The related decree was published due to popular movements that demanded protective policy posture of the countrys national resources. The unilateral decision of Bolivia affected Brazil that is dependent on Bolivian national resources to supply the countrys necessities. It is verified the international affairs between Brazil and Bolivia was signed under the support of the international law that evolved excesively care for political, social and economical context of each Sovereign State. Among the existing mechanisms of contoversy solutions in the international law, Brazil used the direct negotiation with Bolivia. With the repercussion of the nationalization of the hydrocarbons without obeying the agreement signed under the international law support, this work presents empirical research accomplished to verify if Brazil could have gotten more benefits using other mechanisms of conflict solution. It was checked after the data analysis of the research achieved that the demand guiding to an international organism could be beneficial for Brazil, considering that there was support in the contracts signed for the present measure. Furthermore, several aspects that provide a wide view of the context in which the problematic is inserted were analysed.
