RESUMO

The present study approaches the Brazilian administrative reform of 1995, with especial focus on the management of the public services, by means of partnership with the private initiative, and the regulatory agencies. In the context of the public administration, the reform intends to reduce the bureaucratic insulation and to extend the social participation, some times through the installment of the public service by private, other times through the social control representing the citizens. With the goal of implementing efficiency in the administrative activity, the installment of the public service, mainly the service of general interest, it was transferred to the private initiative either by concession or permission. As a result of the partnership between the State and the private companies, the regulating activity of the State amplified and passes to be developed by independent beings of the government - the Regulatory Agencies of the Public Service. Although the reformation project had not clearly foreseen the regulatory agencies, they have been, little by little, gaining institutional space in Brazil. They assume the condition of special autarchies, which have seen their autonomy ahead of the government, and are endowed with evident normative and sanction power. The regulatory agencies have been severely criticized by the Brazilian doctrine because possible inadequacy to the national native administrative system. The most criticized aspects are the independence in relation to the central power of the Head of the Executive and the emphasized normative power. Herein, it is understood that the crucial critic on the regulatory agencies in Brazil is related to the possibility of capture of their controllers. Appropriate functioning of independent regulation is not efficient without strong instruments of control, especially social control by society
