Proteção prolongada do amental

RESUMO

As the principles of the dignity and equality must guide the native legislator in the elaboration of new laws to the amental and so that it does not remain only in a plan of the ideas, the presented thesis had its main focus in the creation of a new regimen for the deficient intellectual, of legal age and disabled, named extending familiar power, institute already in the Spanish right, and in belgas right as minorité prolongée, in case that they have parents or one of them alive one, in substitution to the institute of the curatela, considered for the foreigner doctrine as retrograde. For the rank in the new regimen, the declaration of incapacity will be made through the interdiction process, faster, simpler with little advertising, where the interdicted one will carry an identity card determining the limits of its acts. As the tutela is similar to the familiar power also approached the possibility of being the tutela and not the curatela the better institute of protection of deep amentals, if parents died or lost the familiar power. For the cases of few intellectual deficiency, it was thought about the procedure of disability and not of interdiction. They would be under the regimen of the curatela. We believe that the deficient deep intellectual will be more protected
