RESUMO

ABSTRACT The brazilian constitution of 1988, reflecting a democratic social state, consecrated, among other fundamental rights, the social rights, including health. Thus, it proclaimed, in art. 196, that health is a right of all people and a duty of the state, and it is guaranteed by means of social and economic politics that aim at the reduction of the risk of illnesses and other injuries, and at the equal universal access to the actions and services for its promotion, protection and recovery, configuring them as having public relevance (art. 197). Taking account that this right lacks effectiveness, the present work tried to understand the model of health assistance printed in the current constitutional text, its characteristics and informative principles, in order to, subsequently, examining the state responsibility in result of its omission. For this, we made a brief historical incursion into the subject of the civil liability, its evolution, types and characteristics, proving that the responsibility for the omission is closely connected to the breach of certain legal obligation to act. For this reason, the extension of the duty imposed to the state of providing health, and the presumed responsibility omissions commonly invoked to justify the state abstention were approached. Afterwards, we demonstrated the means that the legal system offers for demanding and assuring the state responsibility. Among them we recognize the roles played by the public ministry, judiciary power, courts of accounts, as well as the society, in order to verify the possibility of judicially compelling the public administration to implement certain public politics, when not fulfilling the constitutional rules. Such controls, if well exerted, confer effectiveness to the right to health.
