Mudança institucional e custo da transferencia internacional de tecnologia no Brasil : o caso das montadoras de automoveis nos anos 90

RESUMO

In the 90 he cost oftechnology intemational transfer attracted again the attention ofBrazilian researchers. This applies to the notable increase of imported technology payments. The annual remittance jumped from US$ 200 million, in 1990, to approximately US$ 2 billions in 1999. In this view, the automobile industry volume of contracted technology, which passed from modest levels in the beginning ofthe decade to an expressive amount in its end, was outstanding. The increase of the technology imports costs was a result of a change in the Brazilian related legislation, specially the law 8.383/91. This law allowed the royalties remittances and its deduction in income tax from the multinational affiliates to their headquarters. Besides that, the new Manufacturing Propriety Code ncreased the intellectual propriety rights, what weakened the bargain power of local enterprises in respect to technology foreign suppliers. Moreover, the new code decreased the time of contract registration when it established a limit of 30 days. It occurs that the modification ofthe Brazilian law wasn t unfounded, but the result of an institutional change at the intemationallevel caused by the creation of World Trade Organization (WTO). One of the main accords to the members countries was the enforcement of intellectual propriety rights, ordained in the literature as TRIPs (Trade-Related Aspects ofIntellectual Property Rights). As a consequence, Brazil and others developing countries assist to the improvement of the direct costs, related to technology payments, and of the indirect costs, related to negative impacts on local technological capacities. Some of the Brazilians cars assemblers, with prominence to Ford and Volkswagen, also increased their dependence to the foreign technology, contributing to the global increase of technology transfer costs. Basing on a bibliographic revision that discusses ITT for Brazil, in the 90 e study the cars factories, based on the analysis of summaries from legalization certificates of technology transfer contracts of these enterprises.
