RESUMO

This thesis aims to analyze the functioning of the justice for a kind of crime rarely studied in Brazil crimes in the traffic. The statistics reveal that a great number of people dies due to the traffic in Brazil. Many of those deaths are considered homicide crime in the traffic, even because with the creation of the Brazilian Traffic Code, that attitude was criminalized, which demanded a new attribution for the justice - to judge the cases of drivers that have killed in the traffic. Therefore, it is important to understand the actions of justice in judging those cases, and also the administration of justice for that kind of crime. More specifically, this work goals to study the justice for the crimes in the traffic that have occurred in the city of Belo Horizonte/MG. The chosen methodological procedures were: the observation of the audiences, data collection in the traffic processes judged in the district of Belo Horizonte in the year of 2006 and interviews with the main actors of the criminal court system. While collecting the data, one can observe that Brazilian justice system for the homicides in the traffic reproduces the effective model of hierarchization in which the defendant s characteristics are taken into account in the process of sentencing. Such characteristics are: race, socioeconomic condition and if the defendant is or not employed. The solution for the social conflict reveals that same subjects are sentenced in an unequal way.
