RESUMO

Over the judicial pretensions of Fundo de Pasto Communities recognition, there is one atmosphere of no credibility on their rights on the land they traditionally are. It removes from their word experience the innovations in life projects as perhaps more democratic ways of access and use of social, cultural and environmental property they develop as well as their rights. The last decades watch the public ascension of these actors what brakes the old hierarchzed and heteronomous standards that labels our politic and judicial life with significant judicial and public politics conquers. However, in spite of their rights conquer of recognized ways of to produce, live and make, and the constitutional acceptance of judicial pluralism since 1988, these rights dash in texts and practices based in concessive formulations from personal or collective citizenship state or private custody. The situation retrace to the XVII century local cattle raising expansion, goes through the state answer to these actors in the 1980 and get power in the process of the constitution of Bahia in 1989. In spite of the formulation of the popular initiative propose, the unique paragraph of the article 178 of the Bahia Constitution presents a rule that became the interdict these communities as protagonist. So, the present work is like a judicial cartography to present problematic aspects in the social construction of the politic dignity of right, according to Lyra Filho suggestion and the investigative standards of the theoretical propose and social praxis of one Right Find in the Street.
