RESUMO
this article elaborates over a fundamental subject for the right functioning of political parties in a democracy: the funding of its activities. After 35 years of Spanish democracy, with various laws passed on the financing activities of political parties, there is still a significant problem present in current political activity already diagnosed by the Political Science and Law: irregular funding, corruption and a lack of transparency and publicity expected in a democracy. The persistent lack of legal efficiency in the subject of funding justifies the pursuance of a critical analysis which follows the following interrelated objectives: to contextualize the relevance of funding within political parties for the functional stability of democracy; to analyze the Spanish financing model in democratic times, putting special emphasis on the current LO 8/2007 act; to reveal the persistence of old diseases, and the new lost opportunity in terms of improving the funding, transparency and control of political parties which has meant the recent legal reform (LO 5/2012, 22th of October).
