RESUMO

Analyses unfair competition, through Brazilian and foreign doctrines, specifically applied to distribution agreements. Initially, the Brazilian constitutional principies of freedom of initiative and competition are discussedI as well as the concept of monopoly. After that, the definition and legal nature of unfair competition are studied, together with the several unfair competition acts, according to Brazilian legislation. The distribution agreements are then defined and studied, in relation to the manufacturer and distributor responsibility facing the consumer. The territoriality and exclusivity clauses are specifically approached, as the gray market phenomenon. It concludes that it is possible to verify unfair competition through distribution agreements
