RESUMO

This dissertation focuses on the identification of the mechanisms institutionalized by the formal agencies such as the Precinct for the Protection of Women (Delegacia dos Direitos da Mulher), the Public Prosecution Office (MinistÃrio PÃblico), the Special Criminal Court (Juizado Especial Criminal), and the Regional Labor Office (Delegacia Regional do Trabalho) which are located in the metropolitan area of Recife, and directly deal with claims related to Sexual Harassment. It is an empirical analysis of qualitative methodology within the period of 2001 and 2003. The main Feminist Theories, the Rational Choice and Historical Neoinstitutionalism are the core strands of theories employed in this analysis. The key assumption is that the enforcement of the Sexual Harassment law is directly related to the rational choice of the actors based on the institutions (formally or informally) comprised in each agency. In the case of the first agency, the Precinct for the Protection of Women, we conclude that the sexual harassment claims are concealed due to the private and subjective institutions, because the payoffs are not rewarding if they were sorted out. In the case of the Public Prosecution Office and the Special Criminal Court, we conclude that the actors opt for a suboptimal rational choice so that equilibrium is achieved that suit both the agency and the victim. And finally, in the case of the Regional Labor Office, the rational choice is for the resolution of the conflict as the institutions are uniform, public and objective. The conclusion is that the mere approval of a new law, which aims to protect women from discrimination, doesnât assure that the right sheltered by that law would automatically be ratified by the agencies responsible for dealing with the claims, since the institutions do matter
