RESUMO
One of the most interesting news brought by the legislature of the Civil Code of 2002 was the formal discipline of the preliminary contract, under arts. 462 to 466 of the current civil law. Occurs that institute is not new in our town, nor in foreign laws, and a species widely used especially in negotiating real estate transactions. The objective of this study is to address in detail the preliminary contract. Thus began our search-differentiating some species of the contract. Then tours the historical analysis of the matter and take care of the details and controversies involving the subject, especially the effects in terms of specific performance and award cumpulsória, taking as background, the focus or the practical applicability of this species contract in our legal system
