RESUMO

The crisis in the administration of justice is a crisis of a positivist paradigm, dominant today in the juridical culture. It is formed due to a lack of ideas, methods and principais, achieving true justice through the juridical, which is made up of an application of the general law in order to settle private lawsuits. Through the analysis of the historical constitution of our juridical culture it is apparent that some elements of the past are permanently significant in the administration of justice - the principal of the supremacy of the law, the necessity for independence and neutrality of the judges in resolving lawsuits, and the fear of the influence of politics in the law. Other elements were separated from the scope ofthe law- equity, and the naturallaw. In addition, other elements have emerged in the last few years -the idea of the citizen judge (juiz cidadão), the alternative use of the law (uso alternativo do direito), a critical theory of the lawthat incorporates the common sense in a process of intellectual and moral reform of society. The action of overcoming the crisis of the juridical culture, and the crisis of the administration of justice should appear from the articulation of the progressive elements presents in this culture, in a hegemonic project of a plural and radical democracy
