RESUMO

This dissertation intends to analysing the close connection between the god faith principle and the indecent assault of right almost its correspondent theory devoted in brazilian juridicy order after the publication of the Civil Code in 2002. The detailed reflection about the indecent assault of right theory in Europe has highlight place in the process of comprehension about the limits of that break the regular exercise of the subjective rights. Starting from the fixation of this institute at the article 187 of the brazilian Civil Code great discussions about judicial nature and the fixation of the limits that get around the institute of the indecent assault of right intending to avoid the incident (including the frequency) of abusive practices in the contractual private relations. The contracts in its self appoint the social economic and judicial importance deserves special protection like an institute historically devoted. Therefore in front of the renovation of the Civil Law under the influence of the personal dignity principle this text proposes a new reading about the classical principles of the right contracts under the light of that is informed from the modern principles in special the elements of socially and ethic. In these terms emerges the relevance of the good faith principle that deserves attention because of the hard work in the interpretation integration and limitation of the judicial deals. Starting from this expose about the historical and conceptual trajectory of this principle and the reflection about the necessity of protection of the contractors in their deals in front of the hypotheses of indecent assault of rights in the reason of the violation of the ethic rules informed for the objective good faith that works like the more efficient criterion of the indecent assault of right in the modern contractual theory.
